Licensing & brand use

Names. Cosmik Labs (long form), CosmikLabs (full name), cosmiklabs (GitHub handle) and Cosmik (short form) all name COSMIK LABS, LLC and its GitHub organisation. COSMIK LABS, LLC holds the copyright in this repository's own material and holds the marks, including the HPLX marks. The fonts and the vendored foundation keep their own terms (sections 3 and 4).

This repository holds the HPLX family of the Cosmik brand, which until release 0.7.0 lived in cosmiklabs/brand under kits/hplx/ and was licensed by that repository's LICENSE.md. The same terms continue here. The repository mixes four kinds of material with different rights. Each part is covered separately; a licence for one part says nothing about the others.

1. Tooling, token data and written guidance: MIT#

Covers:

scripts: everything in scripts/;
token sources and generated token files in tokens/;
repository configuration, tests and asset-manifest.json;
all written guidance, including README.md, EMBER-HISTORICAL.md, tokens/README.md and the other Markdown documentation.

The MIT grant covers the written instructions, not the artwork or marks embedded in or referenced by them. Those remain subject to section 2, and fonts remain subject to section 3.

A permissive licence on the token values lets any project, including a fork, reuse the palette, spacing and type scale. Colours and spacing are not the identity; the marks below are.

2. Brand marks: trademark-style policy#

Covers the HPLX marks and artwork: every file in assets/ (Glimmer, its lockups, the historical Ember, its lockups and their sources), the app icons in icons/, any render of them, and the brand artwork embedded in guide files. These were covered by this same policy as the files of kits/hplx/assets/ and kits/hplx/icons/ in cosmiklabs/brand. The written instructions in these files are covered by section 1.

These marks and artwork are not licensed under section 1 or under the licence of any project that ships them. COSMIK LABS, LLC keeps all rights in them, subject to the permissions below.

Who may ship the marks.

Official Cosmik projects: repositories under the cosmiklabs GitHub organisation and the builds, installers, websites and documentation published from them by Cosmik Labs. They may ship the marks unmodified, as supplied in this repository, following the brand guide.
Contributors to an official Cosmik project may use the marks while working on that project, including in local and test builds.
Anyone may refer to Cosmik and its projects by name and may show the unmodified marks to identify them (for example in an article, a review, a catalogue entry or a link), provided it does not suggest endorsement, partnership or official status that does not exist.

Unmodified means: the supplied files, or exact renders of them at another size, in the supplied colour variants. No redrawing, recolouring outside the supplied variants, stretching, rotating, cropping, added effects, or resetting the lettering in another typeface (see the HPLX guide).

Forks and derivative distributions. A fork of a Cosmik project, or any build not published by Cosmik Labs, must remove the marks and must not use "Cosmik" as its own name or imply it is an official Cosmik release. It may state factually that it is "based on" or "a fork of" the Cosmik project. This applies whatever the code licence of the forked project: a copyleft or permissive code licence grants rights in the code, not in the marks. For GPL-3.0 projects, this is the declination of trademark rights that GPL-3.0 section 7(e) permits.

Everything else (merchandise, third-party products, modified marks, co-branding) needs written permission from COSMIK LABS, LLC.

3. Fonts: SIL Open Font License 1.1#

The typeface in fonts/ is not Cosmik Labs' work and stays under its own licence, the SIL Open Font License 1.1:

Spectral (the HPLX family's headings): fonts/licenses/Spectral-OFL.txt

Preserve this notice whenever the font files are redistributed. fonts/web/Spectral-SemiBold.woff2 is a lossless WOFF2 wrapper of the bundled TTF (every table byte-identical; see scripts/build-web-fonts.mjs). Using the font here implies no endorsement by its authors.

4. The vendored Cosmik foundation#

vendor/brand/ is an unmodified copy of a tagged cosmiklabs/brand release, recorded in vendor/brand/brand.lock.json. It is covered by its own vendor/brand/LICENSE.md, which travels with it: MIT for its tooling, token data and written guidance, the trademark-style policy for the Cosmik marks, and the SIL Open Font License 1.1 for Inter and IBM Plex Mono, whose notices are in vendor/brand/fonts/licenses/. Nothing in this file changes those terms.

Official projects are the repositories in the cosmiklabs GitHub organisation; a project elsewhere becomes official by moving there.
The marks are claimed, not registered. Nothing here claims a registration.
